Frequently asked questions

Can I use this lien waiver in every state?

No. Several states, including California, Texas, Arizona, Georgia and Michigan, require their own statutory lien waiver forms, and a non-statutory waiver may not be enforceable there. Check the rules for the state where the project is located, and have an attorney review waivers on large or disputed payments.

Which lien waiver should I send with my pay application?

Most GCs ask for a conditional progress waiver for the payment you are requesting now, and an unconditional progress waiver for the payment you already received last period. At the end of the job, the same pattern applies with final waivers.

What is the difference between conditional and unconditional?

A conditional waiver only takes effect once you are actually paid. An unconditional waiver takes effect as soon as you sign it, whether or not the money arrived. Never sign an unconditional waiver before the funds have cleared.

What should go in exceptions?

Anything you are not waiving: disputed amounts, unpaid change orders or extra work, or claims you are still pursuing. Progress waivers in this template already exclude retainage and work after the through date.
